• [She] died 2/4/1944, in the hospital where she had been for 16 days after having been hit by a car on 1/11/1944 at 2nd and Reed streets. Her femur was fractured but cause of death was apoplexy and arteriosclerosis. She lived at Box 23 Winchester Road. She had lived in the county for 20 years. Funeral cost $247.25.2722

Woman in Two Accidents Dies

Mrs. [sic] Emily Gallagher, 60 [sic], died in San Jose Hospital yesterday, the victim of one of the strangest sequences of accidents on the local records which occurred January 11.
First struck by a car driven by Pvt. George Swan, Moffat Field at 2nd and Reed, Mrs. Gallagher was injured for the second time when the Freemans Ambulance in which she was being taken to the hospital overturned at 19th and San Carlos after colliding with a car being driven by Dr. Joseph Miller, 1068 Camino Pablo.
Amos O. Williams Funeral home is in charge of funeral arrangements which await word from a niece and nephew believed to be her only relatives.2722, pp 1-2

• [excerpts] It stopped raining so I drove to San Jose to look through Emily Gallagher’s probate files at the courthouse. There wasn’t much, except that the estate made some sort of settlement with the driver of the car that hit her and the driver of the ambulance too, that went towards paying some of her final medical bills.
Basically, she died intestate.
According to the records, the state decided that Emily had three legal heirs. They were her brother, Ward, her niece Jennie H. Eliason (child of Jennie Gallagher Hamilton, deceased), and her niece Naomi Dafoe Spencer (child of Mary Gallagher Dafoe, deceased). (Jennie and Mary Gallagher were sisters of Emily’s, according to the document.) These three split the estate between them equally...the residue of the estate was $1,696.62.
Another document said that Jennie H. Eliason was living in the Montgomery Apartments, Apt B-21, Narberth, PA and that Naomi D. Spencer was at 319 Washington Ave, Alpena, MI. (This was in mid-1944.)
A notice from the tax appraisers file said that Emily’s assets (before creditors were paid) was cash of $1,651.95 and interest in the estat of Fred E. Gallagher of $318.25. There was no real estate...so that big house and orchard near the Winchester Mystery house must have been sold earlier.2723
